Acceptance of these terms and conditions of sale

These terms and conditions apply to the sale of Château ROQUEFORT products on the store accessible via the internet, by telephone, by email and by fax. They are automatically made available to the purchaser on the homepage of the Château ROQUEFORT website. As a result, the act of placing an order implies full and unconditional acceptance of these ‘terms and conditions of sale’ (hereinafter T&Cs) by the purchaser, excluding all other documents such as flyers, press, catalogues or email shots sent by the seller which are solely indicative. The fact that the seller does not cite one of these general terms and conditions at a given time may not be interpreted as a waiver to the right to cite any such conditions at a later date. Our offerings are reserved exclusively for eligible private individuals of majority age. If you are a professional, in order to comply with current legislation, please let us know so that we may prepare an SAAD (simplified accompanying administrative document) to accompany the goods.

These T&Cs may be modified at Château ROQUEFORT’s initiative, giving seven days’ notice. The amended T&Cs are then applicable to all transactions recorded on the website from seven days after the modified version of the T&Cs is first published online.

If a natural or legal person places an order on the Château ROQUEFORT website, this constitutes full and unconditional acceptance of these T&Cs.

Proof

The data recorded by the website constitutes proof of all orders.

Unless explicit reference is made to copyright held by a third party, all data appearing on this website (text, images, graphics, logos, icons, information content etc.) is its own exclusive design protected by both copyright and intellectual property rights. Any unauthorised usage or reproduction, either in full or in part, will be prosecuted.

The trademark Château ROQUEFORT is registered under the numbers 9498886 / 000854992 / 98711602 / 9510881. Any reproduction or imitation will be prosecuted as a counterfeiting offence.

Use of personal information

This site has made a CNIL declaration under the number [registration process ongoing] (Simplified standard no. 48). The information gathered by the website’s interfaces is required to handle orders, payments, loyalty programmes and sales promotion. The site distinguishes between mandatory information (marked with an asterisk) and additional information. Data may be communicated externally (i) without prior agreement for any marketing activities for similar or analogous products from the company or a company within the same group; (ii) with the customer’s prior agreement in other cases. This information may also be communicated in order to meet legal and regulatory obligations and to court and judicial officers responsible for recovery.

Data is kept (i) for 10 years for all orders placed; (i) for 3 years from the last order or website for personal information; (iii) for 6 months for data saved on user terminals.

When visited, the website can automatically generate information stored on the service user’s terminal to ensure improved orientation according to the user’s past preferences and make navigation friendlier. Orders

Photos and assessments of products are provided for informational purposes only and are not contractually binding. In particular, the quality and dates of photos may result in a difference in bottle colour or presentation.

Orders only become definitive upon confirmation of the order being accepted via a confirmation email. Goods are only handed to the carrier following advance payment in full for the goods ordered and the transport costs.

The seller reserves the right to refuse any orders from customers with whom they have an ongoing dispute.

If the purchaser does not want immediate delivery, the seller may hold the items included in the order on the customer’s behalf for 15 working days (3 weeks) from the date of the order. After this deadline the bottles will be returned to stock, the purchaser will be reimbursed for the total amount of their order, and product availability will no longer be guaranteed for the initial purchaser.

Price

Prices for all wines are given in euros (€) including tax (20% VAT), excluding shipping costs. Unless otherwise stated, any changes to the VAT rate will be reflected in the public price as soon as they enter into force.

Promotions

Discounts and promotions cannot be combined and are given only once per household (same name, same address).

Promotional codes cannot be combined: only one code may be used per transaction.

Shipping costs

Shipping costs vary according to order volume and delivery address. Please contact us for any orders outside of mainland France.

Delivery times

Delivery times are indicative and are calculated from the point when the customer’s data is verified by Château ROQUEFORT for deliveries without settlement in advance, and from receipt of the payment or bank authorisation for deliveries with settlement in advance (debit or credit card online).

Failure to meet delivery times does not entail entitlement to damage, interest, deductions or cancellations of current orders. However, if the goods still have not been delivered within a month of the customer filing a written complaint, the sale may be cancelled at the instigation of either party. The customer will receive a refund of their payment, excluding any other compensation, damages or interest, within a month at the latest. In any event, delivery can only be completed within the time period if the customer has provided the seller with exact contact details for the addressee. If there are any errors, Château ROQUEFORT cannot be held responsible for inability to deliver the goods to the desired destination at the desired time. Goods are always shipped at the customer’s risk. Upon receipt of the goods, it is the recipient’s responsibility to immediately check their condition and make any observations necessary in the event of breakages, damage or missing items, both by annotating the delivery note and by sending a registered letter with acknowledgement of receipt to the carrier within 48 hours of receipt of the goods, copied to the seller, to preserve their rights.

Goods are paid for in full upon placing the order, in one of the following ways:

Château ROQUEFORT reserves the right to request payment by bank transfer for all orders. In accordance with the provisions of article L 441-6 of the French Commercial Code in the version in force on January 1st 2013, any sums not paid within thirty days of the due date are increased by the statutory interest rate plus three percentage points. Late penalties become payable without the necessity of a reminder. A flat rate of €40 as set by decree number 2012-115 of October 2nd 2012 will also be payable for recovery costs in the event of late payment.

Right of withdrawal

Pursuant to article L. 121-16 of the French Consumer Code, the customer has a period of fourteen days from delivery of the order to return any unwanted products in their original packaging for exchange or refund, without incurring any penalty with the exception of the return shipping costs. In all such cases the customer must inform the sales service in writing (telephone, email, fax, letter) of their decision before returning the goods.

Termination of contract

In the event of non-payment by the customer within the agreed deadline and a month after a formal notice has been provided with no result, the sale will be cancelled ipso jure if the seller sees fit with the refund of any deposits paid by the purchaser, and where relevant the option for the seller to also request the return of any products already delivered, without prejudice to any other damages or interest. In the event of a recovery by legal means, an inclusive payment corresponding to 15% of the amount of the order will be applied.

Seller’s liability

All products supplied by Château ROQUEFORT are covered by a legal guarantee provided for under articles 1641 et seq. of the French Civil Code. Any visible defects must be reported in writing within eight hours of receipt of the products, with supporting evidence under penalty of foreclosure. In the event of a product sold not conforming to the order, it may be returned following a claim being validated by the seller. In both cases the seller may choose whether to exchange or to refund the purchase price. Any complaints or requests for exchanges or refunds must be made by post to the Château ROQUEFORT company address stated below within eight days of the delivery date. The guarantee for hidden defects applies in line with the terms and conditions prescribed by law. The guarantee for hidden defects does not cover any accidents and in particular any damage caused to the product as a result of inappropriate transport and storage conditions for the product (temperature, moisture, exposure to light).

If required, it is the purchaser’s responsibility to seek advice from the seller to enable them to ensure that the product ordered is stored properly. The seller offers no guarantees on this count.

Liability in the event of website failure or suspension of service

Château ROQUEFORT accepts no liability resulting from interruption of access to the website and/or any technical malfunction or failure of any kind, regardless of duration or frequency. All users are reminded that they can contact the ordering service by telephone.

Applicable law and jurisdiction

These T&Cs are subject to the application of French law, the provisions of the Vienna Convention of April 11th 1980 are not applicable to deliveries abroad.
For sales between professionals, the courts of Château ROQUEFORT’s registered office will have sole jurisdiction for any disputes arising from orders placed on the website. For sales between private individuals, French rules of procedure and regulation no. 44/2001 shall apply in the event of a dispute arising from a delivery in the territory of the European Union, and the Lugano Convention shall apply for deliveries in the territory of a signatory country.
